He was arrested a month ago for falsifying a prescription for hydrocodone. Charges were never file by the DA so he was released in 3 days. He was never told charges would still be filed. The courthouse people even told me they didn’t press charges so we all resumed our lives. He started counseling and is trying to get divorced and sell his house. Well today the family law facilitator calls him and says the ex is trying to get temp custody and has a court date set for that tomorrow…..but….he now has a felony warrant that was issued yesterday. The charges are falsifying and burglary in the 2nd. This is his first drug offense but he already has a felony that he copped a plea to a few years ago but inadvertantly involved the drug too. So basically clean for a month, cleaned up his life, trying to clean up his act. What will the judge offer him or try to do? He will turn himself in on Monday to guarantee going to court and not sitting over the weekend. Again, it turned into a warrant after DA filed charges. I think that is weird but I don’t break the law either, so I’m clueless. sorry at this point I’m rambling. Oh by they way we are in California.
Would he be offered drug diversion in any case? I mean they let him go so weren’t too worried about him.

First, I would recommend that if he can afford counsel, that he have an attorney BEFORE he appears on the warrant. The attorney may recommend that he appear in court rather than turning himself in to the police. If he can afford to post the bail or buy a bail bond now, he might consider doing so–then he will only have to appear in court at some later date. (However, if he waits to see what the court does with bail he might be released without bail, or on a lower bail, and save some money.)

A warrant can be issued anytime charges are filed when the defendant is not in custody, it does not mean the defendant failed to appear at some prior time. However, the usual course is to notify the defendant so that he can voluntarily appear in court without being arrested. The first thing he has to do when he appears in court is ask for a lawyer if he does not have one. Then the first goal will be to secure his release on his own recognizance or upon reasonable bail pending further proceedings. You are quite correct that the fact that he was released and they waited a month to file charges weighs in favor of pretrial release. A voluntary appearance helps, too.

In my experience, a prison sentence is unlikely in a non-violent case such as this. The burglary charge is just based upon his entering the store with the intent to unlawfully obtain the narcotic. I don’t think drug diversion is available on this type of charge (though I could be mistaken on that–his attorney will know for sure), but I would be surprised if more than a short jail sentence was imposed as a condition of probation.

An IQ is not based on how much information is stored in your brain, but how many thoughts you can process at one time. I, in no way boasting, have one that would confuse you on one word. I am so blessed, im cursed. In no way, do I have much pride at all. The only thing I have to even be grateful for ‘is’ my mind. Most people would do anything to have this ‘gift’ and I am more than willing to get rid of it. In order to boast one must, first, have pride. Much pride and no pride look almost identical, but can easily be proven either way. A person with much pride a certain amount of pressure will "snap". The more pride a person has, the louder the snap will be. A person with no pride will not break under any circumstance. Everyone is born into pride, so, if it is at all possible to have no pride, then one would have had to have been broken at one point in their life. Even a person with very little pride can bottle things up until they pop, but a person who has none, cant. When one’s soul is broken; that is his thoughts and emotions, there grudging pile of problems. Though, in a sense, the soul is still there, a broken glass holds no water; the vessel in obsolete and is good for nothing. Once again, no pride. It is not prideful to argue, but what you argue about. If a person argues over what was said about him, then he fights to right himself, but he who fights over false information, argues to right the other. For from pride is the development of another. With all pettiness aside, who would want a gift that causes grief. Seriously. If a person gives you a pair of platinum prescription sunglasses, would you still wear them if you’re allergic to platinum? What if you’re ears would be pricked and bleed the whole time you have them on? What if you were in the dark for 12 hours of the day? Same to my analyzation here. It just causes pain. A little extreme for an analogy, but still works. Ignorance is bliss only to those who aren’t. Ignorance is hell to those who don’t know better. People do feat what they don’t understand. When people look at something they cannot possibly figure out, their first inclination is to shy away from it, but when it doesn’t immediately resolve itself, then it’s a blotch in that person’s communicable routine. Since they shied away at first glance, and it didn’t go away, they try to come up with a reason or reasons why they did to justify a natural and forgivable response. Making things more difficult and more complex for everything affected by this person and/or persons environment. This is done, once again, out of pride. In order to justify an embarrassing action against an unknown element, they look for quick and quazi-reasonable excuses and explanations for this mere act of stupidity. This doesn’t have to be factual by any means; it just has to make sense to this individuals psyche. Many possibilities can and will stem from this mentality, but is all irrelevant now. When falsified information gets passed to others and in taken as literal truth, then it’s a lie, it doesn’t even have to be taken by the other, but, once spoken, it is a false witness. Defending ones self is prideful, but stopping a lie once it’s spoken to deliver and kind of facts is beneficial to those outside of him. "love," by some people’s interpretation; "power" by mine. Not empowering my self, but giving power to those around me. Knowledge is power. Just remember having no pride is perceived exactly like having much pride, so don’t lean on your own understanding and "never" judge a book by it’s cover. A person may look at something and perceive whatever they wish, but never teach it. As for as other problems needing reasoned out: a person claiming themselves as Christian is an important deal. One, it means "little Christ" or "Christ-like"; two, the person that is saying they’re Christian is actually appropriating themselves as or like unto Christ. You use the title, but act wickedly are doing nothing short of blaspheming Jesus and the Father in him. These same people curse their own brother for what he says about the Bible has, also, blasphemed the Spirit, too. That is more wicked than Paganism. Surrounded by these kind of Christians who are bent to kill has caused a great harm in the kingdom of heaven. If I wasn’t a believer I wouldn’t want this by any means. I am far from being Christ-like but I will call myself a believer. I am NOT Christian, yet. From what I "see" not much is. I want nothing to do with them. The bible I read is all I enjoy. So far, how I read it and what I know about it is evil and blasphemous and all I do is read out loud what I find. Nothing added the Bible is a living word and grows with you and I’m being shown that I wrong. I want nothing to do with this mentality. This organization has countless times shown me through illegal hustles, and corrupted leadership, and the fake being rewarded, and radically misconstrued scripture and not to mention how they deal with students. I want nothing to do with this place. Give me a testimony day (or time to give mine) and I will not "be" a false witness, at least, to myself. I have learned, on the other hand, that I am devoid of understanding of the Holy Spirit. The only thing that this place has done to let me know what I have that’s wrong with me, is that bit of information. I have learned that I am or have been an apostate before I got here. Basically an apostate is a disciple of Christ who is a false prophet without knowing that they are, because there is no Holy Spirit in them to show them the truth. But at the same time, I wont act like something that I don’t know is real. So as far as it goes, How can you record a man’s relationship with God on paper? There is no such thing.I am in a cult and no one knows it, but me. Ha! But I’m crazy!

I have come to the obvious conclusion that society as a whole needs order and direction and this is what religion & its teachings are supposedly for.
So the "book" is full of "the moral of this story is…" stories that are designed to make "man" behave themselves.
I taught my daughter absenteeism not because some "God" was going to be angry with her is she had sex outside of marriage (which is BS) but because…1. She isn’t physically or mentally ready for "sex"…2…if she were to get pregnant she would then have totally succeeded at messing up her life for the next 18 or more years.
So when she was ready she came to me…and we got her on the pill and got condoms and some 45 days later she was no longer a virgin. And now she is 28 yrs old going for her Masters, single, wants no children, and is looking to establish herself with want SHE wants out of life before looking to share life with someone else….and yes she has FTF’s and it is no big deal. Everyone has the same understanding and there are no strings.
The world would be far better off without religion of any kind but a set of MORAL Codes in which to live their lives by. Laws, rules, and regulations….you can bring no harm to anyone and be quite happy and satisfied with that kind of life.
I really pity the people who think that everything they are thinking is a sin…and they must beg forgiveness from some creature that is bigger than life itself on a daily minute by minute basis. How sad is that kind of life? And some people kill themselves over their unworthiness of this God? Give me a break!
I was raised in the church. I was and still am a preacher’s kid. I saw all of the dirt. The corruption and "sin" of the people who came to church on Sunday mornings to beg forgiveness for their sins one day out of the week….Monday came and they were right back to where they were on Saturday night…drunk off their a$$es screwing around on their wives and sometimes with their own kids even!
Religion and the strictness there in is a breeding ground for serial killers, rapist, and the really wacked out people in this world.
Christians can’t even understand the words they are reading in their own book. Even the book of Genesis says that Cain had to leave and go unto the land of NODD and partake of a wife…and this is a contradiction to the theory that were no other people except for the ones that GOD supposedly made….explain that one for me will you….hey there were other people out there….in fact there was already a great deal of people out there even in the time of the book of Genesis…hmmm…go figure….
The there are the plagues of ill health….people died a lot…hmmmm…unclean conditions…lead pipes carrying water to their homes…lead poisoning…whoops the dead ones must have sinned….and God wiped them out!
Then there are the scriptures that say "The Kingdom of heaven is WITHIN us.." What that tells me is that everything I need in order to succeed in life and be happy is already WITHIN me so I don’t need anything else but my brain power and knowledge of how things work in order to be happy in life.
The book is incomplete there are many more books than just the 13 that got edited out when the Roman Catholic church edited and presented the present day Bible as truth. Why did the Roman Catholic Church edit these books out? Because they told the truth and the truth would therefore confuse average Joe and Jane. And most certainly it would have because Jesus Christ was a mortal man, was married and had kids….he left the area to cement the word of Christianity….Hey where did JC go? Well he rode up into the heavens on a spaceship….but he will be back one day to hold you in judgment so you had better behave yourself….will I see you at Church on Sunday….you need to be cleansed from your sins….ya right!
And just what is adultery according to the Bible? Look in the concordances’ of any Bible and read what the Bible has to say about Adultery? The popular belief is that Adultery is sex outside of marriage…..nope…Adultery is a divorced man or woman marrying again…..what does this actual definition from the Bible tell me….1…there are a BUNCH of sinners out there….and 2 just another example of the manipulation of the scriptures to suit the desire of the speakers who are teaching the good? Word! NOT….
So how do I live life….I do my best to bring no harm or ill will to others. I don’t steal from others etc…..and I don’t gossip about another. I have free will so long as it is within the confines of the laws of this land. I take care myself, my family, my land, my animals, and if I can lend a helping hand to others that need it I will. I pay my bills and I work for a living.
As far as how did this world come into being…I don’t care. And where am I going when I die…..I will be going where ever it is that the soul goes….when the body dies….that is it…this is life…you are born and then you die….it is the cycle of life.

I have an ex-wife I am in a custody battle with over our young son. On the stand, in court she admitted to using my medical information to creat an account in my name at a large, national pharmacy chain so she could access my prescription history and have the information e-mailed to her e-mail address. She then printed out my medical information and gave copies to her best friend, her parents, and a friend of mine who immediately told me about it. She also admitted to taking my physical prescriptions and keeping them at her friend’s house. After that she admitted to logging in as me with our former health insurance, as me, and having my medical records transfered to her as well. She also admitted storing these at her friend’s house as well, with her friend’s knowlege. I feel like she has violated my HIPAA rights, she has commited fraud, hacking, medical information fraud, and Identity theft and probably other things as well. This was all admitted to in court, under oath. I have the transcripts to prove it. She did this in an effort to get me painted as a person who abuses drugs and have our child completely removed from me and aparently to have child support increased, etc, etc. Needless to say, this did not work for her. Frankly I was surprised they even allowed her to use any of this as evidence given the admittedly illegal manner in which it was obtained. Now I have been getting wierd nhotices on my credit report and I think she have used my medical information to obtain access to this side of my life as well.

I wanted to know if anyone could suggest a course of action or what recourse I have against her in a circumstance like this. Should I contact the Justice department? I have contacted the insurer and the pharmacy company and they have copies of the transcripts that shoe that she falsified my information and used their systems in an illegal manner. They even admitted that after they looked into my complaints that they could substantiate it. They both gave me a "your concern is noted and we are updating our system to make sure it doesn’t happen again." Basically they aren’t really willing to do a thing. the only thing i can be sure of is she has possion or the friend does of your drugs which depending on what they are, could be a felony! so i hope you have some blood pressure meds or potent pain meds with codine or vicadin…. check with your doctor to see if he/she is aware of them being known drugs for street use. you have transcripts where she states she "stole" them and has them at an alternate location. say at the time she took them the bottle was full but now half full? where did the other 15 go? is she using them? is the friend? did she sell them? all crimes since they are not in their names… and yes she did violate hiipa act since she did not have your permission and she inpersonated you to obtain this info.

I have been prescribed opioid pain medications since a major car accident in 2005. I underwent surgery to correct one of my spinal problems this past february. I had a microdiscectomy at L5-S1. I also have degenerative disc disease at every level from mid to lower spine. I am 24 now, And after 6 years, ANYONE will be physically dependent on opiates. But sometimes (especially when you have to move to another state for one reason or another) and you have to find a new Pain doctor, a lot of them treat you like you are a liar, a drug addict, and half the time, they LABEL YOU a drug seeker; further impairing your ability to acquire relief. As mentioned, I have already had surgery, and im still feeling pain in my upper spine that I was equate with a taser. At my worst, I was prescribed 40mg Oxycontin x3 a day, and 4mg dilaudid every 4-6 hours as needed. I NEVER ABUSED IT. But when I had to move back home, I did everything I was supposed to, I had ALL my records sent to the new doctor: including MRIs, My diagnoses of DDD, Herniated discs, Lumbar scoliosis, my prescription records from a LEGIT pharmacy (CVS), and proof of a family history of rapid DDD. He would not see me because he was convinced that I falsified my info because I was on such high doses of medications at the age of only 22. It is not fair. I am not a junkie. I HATE when I accidently took too much once, I got so sick. but now, I get sick when I DONT take a certain amount because of tolerance. I hate the DEA…

I had the worst time trying to find a decent pain doctor down there that was not a pill mill and was not so afraid of the FDA or DEA that they under prescribed. I have severe PAD, Three surgeries in two year’s, And I’m 45 years old, On disability and I get 120 Percocet 5mg 325, And it took me a long time to find a pain Doctor to prescribe me the pills, I can’t take ibuprofen because I am anemic, And my first Dr would not give me Percocets He told me he does not prescribe narcotics, I told him if I wanted a holistic Dr I would go to one, Every month I was in the hospital getting a transfusion, I had open heart surgery two year’s ago, Ago 43, All the nurses were real nice to me but one, She would make me wait for pain meds, And she told me that when I leave the hospital she will make sure that the Dr will give me as few pills as possible, She was a 22 year piece of garbage, I feel for you guy, Just keep searching till you find a good Dr or go to a pain clinic.

An RN has been accused of falsifying documents in this case a personalized prescription pad of a doctor, which was not used anymore, it was just lying there. An old pad. The nurse claimed she did NOT falsified anything. I believe her. She was simply and admittedly-stupidly jokingly making a phony prescription for a friend as a prank–playing doctor. She used the personalized prescription of this doctor because it was conveniently placed near her (and I believe if there was a generic pad [meaning no name of the doctor at the top, the one that drug-representatives gives to practically anyone] she would have used it and this might not have happened? Unfortunately this was not the case).

What she wrote was comically a combination of drugs, a combination that does not exist at all (but individually this medication exists) and added humorously cocaine to it at the end and continued saying to sniff this 3x a day to relieve stress.. (should anyone be foolish enough that anyone who may have found this (however improbable) to use this prescription, NO pharmacist/nurse/doctor would ever accept this prescription to be legal.) To add, the individual drug used above is real but will still require a special kind of licensed prescription which in this case was not used. Fortunately, this prank prescription was never seen by the doctor who owned the pad. No harm there. This could be easily avoided if it was thrown away in the trash, to which it was. Unfortunately the supervisor who accidentally found it (i don’t know how) decided to make something out of it, investigated it, traced the source, the nurse mentioned above, who was the one who started it all and escalated it by accusing her of "falsification/perjuring/tampering of official or legal documents".

They’re deciding to suspend her without pay or worse fire her from her work-place. She has never falsified documents nor did have the intent to do so. She was not lying, nor copying, forging a real document. Did not physically harmed anyone during the process of this "comical crime" nor used the prescription in any manner to pass it as a legal/real prescription from or under the doctor’s good name nor the intent of destroying the reputation of the physician. Nor used the prescription to gain or access illegal or regulated drugs for herself or to be used of whatever means. Although the prescription pad is real but what was written is not. It’s just a stupid joke. Funny or not funny. It’s a prank. Does she deserved to be accused so? Are the ramifications of her action/s justified? I think she’s guilty of wasting paper. Nothing more.

Unfortunately what she did is a criminal offence committed by a professional person who knew better. I think all she can do is admit to it, admit to poor judgement and hope for the best. In this politically correct world you have to watch your back!

Hello, the reason why I ask this question is not to find out how many people have done so or even to get some myself.

I’ve heard about falsifying licenses frequently and apparently it’s almost an epidemic… but I’m not part of the "war on drugs," especially not one on marijuana.

Regardless, for anyone who has, knows anyone who has, or has even heard stories about it, how difficult is it for one to obtain prescription marijuana with a false license.

BQ: How difficult is it to falsify one of these licenses?

Depends on your state and its laws regarding medicinal cannabis. In California one does not need a license, simply a valid state ID and a recommendation from a licensed doctor to be prop. 215 compliant.

I’m sure it isn’t difficult to counterfeit a license in those states who require one or even a doctor recommendation. However, generally most care givers or medicinal cannabis providers will or are required to verify your recommendation.

I know each time I have visited a new dispensary my ID has been checked, and a phone call and documentation has been verified by the doctor who issued my recommendation.

I got 6 months of open probation where I don’t have to go see my probation officer once a week or whatever. Will I still be subject to a random drug testing? I don’t do any illegal drugs, just my prescriptions from my one doctor?
Just to add a fact, the false reporting was not drug related to begin with.
