yes, in same accident where driver causes an accident by running a red light.

Sober driver gets a ticket for
- failure to obey a traffic signal.

Drunk driver gets a ticket for
– Operating While Intoxicated (over the legal limit)
– Operating Under the influence (impaired regardless of BAC)
– Failure to obey a traffic signal

    Yes, a drunk driver is more severely punished than a sober driver if both cause an accident. The charge of drunk driving is added to any other crime either has committed.

    That is a matter of perception. Either way a driver can have charges levied against him/her regardless of sobriety, BUT if a driver is not sober that will get the original charges plus those associated with drinking and driving.

    Also depending on the charges and situation some drivers can get charges (even ones of their own fault) dropped or at least left off their record. Judges tend to not be lenient with those who drink and drive.
